Judge rules Vanessa Bryant must turn over therapy records in lawsuit over helicopter crash photos

LOS ANGELES — A judge has ruled that Kobe Bryant’s widow must turn over her therapy records to Los Angeles County in her lawsuit claiming she suffered emotional distress after first responders took and shared graphic photos from the site of the 2020 helicopter crash that killed the basketball star, their teenage daughter and seven others.

U.S. District Court Magistrate Judge Charles Eick granted a request by county lawyers to review Vanessa Bryant’s records, the Los Angeles Times reported Monday. But the judge limited the documents to the years since 2017, not 2010 as the lawyers had sought.

“Plaintiff has waived her psychotherapist-patient privilege by placing into controversy the reportedly extraordinary, continuing emotional distress allegedly resulting from Defendants’ photograph-related actions or inactions,” the judge wrote of the Jan. 26, 2020, crash near Los Angeles.

Vanessa Bryant testified in her deposition that because of the photos she has suffered constant fear and anxiety and has had trouble sleeping. She is suing for invasion of privacy, asking for damages for emotional distress. The case is scheduled for trial in February.

County lawyers led by outside counsel Skip Miller argue that the deaths themselves caused her distress, and they sought the therapy records to determine Bryant’s mental state.

The same judge rejected a previous effort by the county to require her to undergo a mental health evaluation.

Her lawyers argued that the effort to get her therapy records was a further invasion of her privacy.

“The County continues to have nothing but the deepest sympathy for the enormous grief Ms. Bryant suffered as a result of the tragic helicopter accident. We are gratified that the Court has granted our motion for access to her medical records, as it is a standard request in lawsuits where a plaintiff demands millions of dollars for claims of emotional distress,” Miller said in a statement obtained by the Times.

Lawyers for Vanessa Bryant didn’t immediately comment.

A Times investigation in March revealed that deputies had shared the grim images of the scene. The photos were shared internally and by one deputy who displayed his cellphone in a Norwalk, California, bar and by a fire captain who showed the images on his phone during an award show’s cocktail hour.

Los Angeles County Sheriff Alex Villanueva ordered all deputies with images of the crash to delete them immediately after learning of a Jan. 29 citizen complaint about the bar incident.

Joshua himself did recently confirm that he had discussed the opportunity of working alongside other coaches in the United States, as well as his long-standing trainer McCracken.

Joshua told iFL TV: “I said, “Rob, look, I got to go out there and I’ve got to find a new coach to work with and learn from as well’. I’m not basing myself in the states. I’m a UK resident, I’m not living out in the states.

“So, to find a new coach must mean I train 11 months, 10 months out of the year and for me, I’m not going out to the states to live and find a new coach.

“I might go out there. I’m probably going to shoot out there again and do some training. Rob’s in Lithuania or something like that or Siberia, like so I’ve got to find other ways to keep myself busy.”

Has Audi bought out the McLaren group?

McLaren Group have released deny that Audi is set to buyout the British manufacturer, and with it also acquire the Formula 1 team which would provide a fast-track to the sport at the highest level for the German auto giant which includes Volkswagen and Porsche in the group.

But McLaren released a stern denial today, seeking to have the original report spiked: They said in an email statement:

“McLaren Group is aware of a news media report stating it has been sold to Audi. This is wholly inaccurate and McLaren is seeking to have the story removed.

“McLaren’s technology strategy has always involved ongoing discussions and collaboration with relevant partners and suppliers, including other carmakers, however, there has been no change in the ownership structure of the McLaren Group,” concluded the statement.

Earlier reports emerged that potential buyout of the whole McLaren Group by Audi, the German Automaker part of the Volkswagen Group.

Autocar reported based on a source, that Audi has bought a controlling stake in the McLaren group, hinting that it would “secure an entry” for the German Automaker into Formula 1.

McLaren has been suffering of financial difficulties recently, and back in April, 2021, the Woking based group announced that it has sold its famous 840,000 square foot facility, known as the McLaren Technology Center, to American firm, Global Net lease for £170 million, on a leaseback basis.

Autocar claims that the buyout will “secure the future of McLaren, which has been operating under heavy financial pressures” and that Volkswagen Group now has access into a potential future F1 foray.

VW has been involved in the latest discussions between F1 stakeholders about the new Power Units to be used in the sport from 2026 onwards, with speculation that both Audi and Porsche, members of the giant German automaker group looking for some kind of involvement in the sport.

Porsche has been linked with a future collaboration with Red Bull racing whose PU suppliers Honda, are currently leaving F1 at the end of the 2021 season.

Steven Gerrard said his first match as Aston Villa manager “can’t come quickly enough” as he prepares for the visit of Brighton on Saturday.

The 41-year-old left Scottish champions Rangers to take the helm at the Birmingham-based club, who sacked Dean Smith last week after five successive league defeats.

Villa are languishing in 16th place in the Premier League, two points above the relegation zone, after 11 games but Gerrard is raring to get going.

“The excitement levels are really, really high,” former Liverpool midfielder Gerrard told VillaTV. “I’m very hungry, very ambitious and the start can’t come quickly enough.”

Gerrard, who steered Rangers to their first Scottish title in a decade last season, said the opportunity to take over at such an “iconic” club was too good to turn down.

“I think coming to Villa, competing against Villa for many, many years, I know the size of the club, I know the standards that are already here,” he said.

“I know many of the players, I played for England with a lot of the players. I played with Ashley Young, who I’ve spoken to, I know Danny Ings very well from his time at Liverpool when I was a coach.”

The former England international’s first game will be at home to Graham Potter’s Brighton on Saturday, following the current international break.

He takes his side to face Jurgen Klopp’s Liverpool on December 11 and also has tough fixtures against Manchester City and Chelsea next month.

Gerrard, considered one of the greatest players in the Premier League era, said there would be no split emotions when he takes his new side to Anfield.

“I don’t think me or anyone else will be able to control the noise,” he said. “For me, that’s not important.

“What’s important is the chance to go to Anfield and win and try and take maximum points, which is the attitude and mentality we’ll have going into every game. It is what it is.

“I want to win every game. My priority and focus, and everything I will give on a daily basis, will be for Aston Villa.”

Deontay Wilder is lining up his next fight as he looks to bounce back from his trilogy to defeat to Tyson Fury last month. Wilder, 36, was beaten in what proved a fight for the ages by ‘The Gypsy King’, eventually stopped in the 11th round having been knocked down three times.

‘The Bronze Bomber’ also dropped Fury twice himself during the bout though, and won widespread praise for his resilient display in Las Vegas, in what was his first fight with new trainer Malik Scott.

The American suffered a broken hand in the brutal clash, but that hasn’t stopped him, and Scott, from plotting his route back to action in 2022.

“With Deontay, obviously, the first fight back is not going to be at the level that he just left,” Scott told World Boxing News. “We have to do things the right way.

“At the same time, we can’t go much lower than that (Fury bout) because he’s a high entertainment revenue fighter. He’s big-time boxing.”

Wilder’s first fight against Fury came in December 2018, when the pair boxed to a controversial draw, and he followed that up with a savage first round knockout of Dominic Breazeale five months later.

Then in November that year, he notched another knockout win when he sent Luis Ortiz to the canvas in the seventh round, before resuming his trilogy with the Fury, although there was a 19-month gap between the second and third bouts due to Covid-19 and then legal wrangling as Fury sought to negotiate a unification clash with Anthony Joshua.

Wilder however, took legal action, and a subsequent court ruling ordered that he and Fury had to indeed meet a third time before the British fighter could face anyone else.

It all means Wilder has not won in more than two years and at 36, the American’s next match-up could prove a crucial one if he is to remain in the world title picture.

NBA’s tampering probe into Lonzo Ball, Kyle Lowry acquisitions in advanced stages

The NBA’s probe into possible pre-free-agency tampering centered on the sign-and-trade acquisitions of Chicago’s Lonzo Ball and Miami’s Kyle Lowry appears to have reached the advanced stages, sources told ESPN on Friday.

The NBA has conducted numerous interviews with team executives and player agents and has gathered electronic messaging of front-office executives of four teams — Chicago, New Orleans, Miami and Toronto — over the past three months, sources said. The league could reveal its findings and any penalties in the near future.

ESPN reported on Aug. 7 about the opening of the league’s investigation into whether illegal contact and negotiation occurred among teams and agents ahead of the opening of free agency at 6 p.m. ET on Aug. 2.

The NBA instituted more stringent penalties in these cases in 2019, including raising the maximum fine for teams to $10 million and including the possibility of suspending team executives, forfeiting draft picks and even the voiding of contracts. The possibility of the contracts being voided is the least likely scenario if punishment is rendered.

Sign-and-trade arrangements are more complicated and time-consuming than typical free-agent player signings, often needing a greater level of discussion and negotiation time to complete.

New Orleans agreed to trade Ball, a restricted free agent, to Chicago on a four-year, $80 million contract for Garrett Temple on a new, three-year, $15.5 million contract and guard Tomas Satoransky. Miami negotiated a three-year, $85 million deal with Lowry in the sign-and-trade that sent guard Goran Dragic and forward Precious Achiuwa to the Raptors.

The Heat guaranteed Dragic’s $19.4 million team option before free agency, which allowed them to use him in the sign-and-trade deal.

The Milwaukee Bucks lost a 2022 second-round pick for tampering charges with Sacramento restricted free agent Bogdan Bogdanovic in 2021. With the penalty, the NBA took into consideration that the Bucks did not ultimately acquire Bogdanovic, as he eventually signed with the Atlanta Hawks.

Phil Mickelson wins PGA Tour Champions finale; Bernhard Langer claims 6th Schwab Cup title

PHOENIX — Phil Mickelson birdied three of the final holes Sunday to win the season-ending Charles Schwab Cup Championship, and Bernhard Langer held on to win his sixth PGA Tour Champions season points title.

Mickelson shot a 6-under 65 at Phoenix Country Club, getting up and down from short of the par-5 18th for birdie to reach 19 under. He joined Jack Nicklaus as the only player to win four of his first six PGA Tour Champions starts.

Langer, who battled back pain all weekend, struggled getting putts to fall as he labored through a 2-under 69. The 64-year-old German finished at 12 under and had to wait for Jim Furyk to see if he would win the Schwab Cup for the fifth time in seven years.

Furyk needed to win the tournament or tie for third and have Langer end up worse than eighth to win his first PGA Tour Champions series title. He dropped in a long birdie putt on the par-4 17th to pull within 2 shots of the lead, but Mickelson’s birdie on No. 18 made it 3 shots.

Needing an eagle to win the Schwab Cup, Furyk pulled his second shot into the grandstand left of the 18th green and had to drop in mulch. He hit his next shot across the green into the rough and got up and down for par. Furyk shot 71 to tie for fifth at 16 under.

Mickelson entered the final round 3 shots behind Furyk and surged into the lead with birdies on Nos. 14 and 15. The six-time major champion had a bogey-free round.

New Zealander Steven Alker, a PGA Tour Champions qualifier just three months ago, shot 67 to finish second at 18 under. Darren Clarke had a 64 and David Toms a 65 to tie for third at 17 under.

Langer shot under his age for the first time in the third round, a sterling bogey-free 63 with bookend eagles that moved him within 6 shots of Furyk’s 16-under lead. He pulled within 2 shots with birdies on Nos. 1 and 4, then rolled in a 15-foot eagle putt on the 306-yard par-4 fifth to reach 14 under.

Langer couldn’t maintain the momentum.

He three-putted for a bogey on the par-5 seventh and took another bogey on the par-4 10th. He finally made a putt on the par-4 17th, giving a sarcastic shrug after it dropped.

Langer played all 39 PGA Tour Champions events in the wraparound 2020-21 season, putting him in position to win another Schwab Cup despite finishing 17th Sunday.

Alker had a dream finish to his first PGA Tour Champions season.

He had no status after turning 50 in July and qualified for the Boeing Classic in August. Alker put together top-10 finishes every week to keep playing and become eligible for the postseason, including a win last weekend at the TimberTech Championship in Florida.

He kept the roll going on Sunday, overcoming a bogey on the par-3 second with five birdies to finish a shot behind Mickelson.

Triplett took the lead at 17 under with a birdie on the par-4 12th, but fell off with consecutive double bogeys after hitting onto the street along the par-4 14th and into the water on the par-3 15th.

Canelo Alvarez is targeting more titles and more history to enhance his prestigious boxing legacy when he bids to become the first-ever undisputed super-middleweight world champion on Saturday night in Las Vegas against Caleb Plant. The Mexican will table his WBC, WBA and WBO straps in a bid to win Plant’s IBF title when the pair go to war at the MGM Grand.

There has already been plenty of needle between the two fighters ahead of this weekend’s highly-anticipated contest.

The fighters traded blows on stage at September’s press conference in Beverly Hills as a right hand from Canelo drew blood just under Plant’s eye.

Plant is no mug to his credit, boasting a record of 21-0 and four successful world title defences since winning the red strap in January 2019 against Jose Uzcategui in Los Angeles.

But he will have to turn in, without doubt, his best ever career performance if he is to pull this off against the pound-for-pound king Canelo.

The 31-year-old has lost just once in 59 professional outings, winning seven consecutive fights since his controversial draw with Gennady Golovkin at the T-Mobile Arena in Las Vegas in 2017.

Canelo successfully stopped Billy Joe Saunders last time out in Dallas, Texas when he shattered the Brit’s eye socket in the eighth round of a pulsating contest.

Many are expecting Canelo to close the show again this time around against Plant before potentially moving back up to light-heavyweight where the likes of Artur Beterbiev and Dmitry Bivol await him.

Canada will be without its two biggest names at the Davis Cup Finals later this month.

Felix Auger-Aliassime and Denis Shapovalov have both pulled out of the international tournament, Tennis Canada said in a statement Sunday.

Auger-Aliassime, 21, said he’s been dealing with an injury for “quite some time now,” adding that his doctor has recommended rest.

Shapovalov, 22, also cited rest in his decision to withdraw.

The competition is set to take place Nov. 25 from Dec. 5. Canada opens against Sweden in Madrid before taking on Kazakhstan.

The pair will be replaced by Toronto’s Steven Diez on a squad that also includes Vancouver’s Vasek Pospisil, Brayden Schnur of Pickering, Ont., and Peter Polansky of Thornhill, Ont.

Montreal’s Auger-Aliassime, ranked 12th in the world, Shapovalov of Richmond Hill, Ont., ranked 18th, and Pospisil were part of the Canadian team that advanced to the final tie of the 2019 tournament before losing to host Spain.

“It is always with great pride that I represent my country and therefore it is not a decision that I have taken lightly,” Auger-Aliassime said in Tennis Canada’s press release. “The team has all of my support and I wish them the best.”

Shapovalov lost Saturday’s final of the ATP 250 event in Stockholm to Tommy Paul of the United States.

“It’s always a pleasure and an honour for me to represent my country,” he said. “But I need some rest in the off-season.”

Auger-Aliassime as represented Canada at the Davis Cup four times. His successful 2021 season saw him reach the semifinals of the U.S. Open and rise to a career-high 11th in the ATP Tour rankings.

Shapovalov, meanwhile, has played in eighth Davis Cup events. On top of Saturday’s final in Sweden, he reached the Geneva Open final and the Wimbledon semis in 2021.

Diez, 30, will make his second Davis Cup appearance for Canada, and first since 2010. He’s currently ranked 259th in the ATP rankings.

“We know that Felix and Denis have always made the Davis Cup one of their top priorities,” Canadian captain Frank Dancevic said. “”But it’s been a long and even more trying season due to the protocols and measures put in place to help combat the spread of the COVID-19 virus, and we completely understand their decision.
